What Is the Stormwater Annual Report?

The Annual Report is a required document that all IGP-covered facilities must submit each year through the SMARTS system (Storm Water Multiple Application and Report Tracking System).

It summarizes your facility’s compliance with stormwater requirements over the previous monitoring year, including:

• All stormwater sampling and monitoring results
• Exceedances of Numeric Action Levels (NALs)
• Updates to BMPs (Best Management Practices)
• Any changes to your facility operations
• Your current Exceedance Response Action (ERA) level
• Certification from the Legally Responsible Person (LRP)
  

The reporting year runs from July 1 to June 30, and reports are due by July 15.

Why Is the Annual Report Required?

The State Water Resources Control Board requires Annual Reports to ensure that industrial facilities are:

• Properly monitoring their stormwater discharges
• Maintaining and updating their Storm Water Pollution Prevention Plan (SWPPP)
• Implementing effective BMPs to protect water quality
• Responding appropriately to any exceedances of regulated pollutant levels
  

These reports are used by regulators to verify compliance and by environmental groups in the case of third-party lawsuits.

What Does the Annual Report Include?

Stormwater Sampling Results - All lab results from qualifying storm events during the monitoring year.

‍Monitoring and Inspection Records - Visual observations, monthly inspections, and maintenance logs.‍

Narrative Summary - A brief written assessment of BMP effectiveness and any changes made to the facility or SWPPP.‍

Certification - The report must be certified by the Legally Responsible Person (LRP) via SMARTS.

What Happens If You Don’t Submit On Time?

Failing to submit a complete and accurate Annual Report by July 15 can lead to serious consequences, including:

• Notices of Violation (NOV) from the Water Board
• Fines and penalties for noncompliance
• Legal action from environmental groups under the Clean Water Act
• Risk of escalation to ERA Level 1 or Level 2 status
• Difficulty demonstrating due diligence during regulatory inspections
